Consent to the Processing of Personal Data

An individual, hereinafter referred to as the “Data Subject”, by placing an order or submitting an application, or by sending an inquiry through the website neartogether.com, hereinafter referred to as the “Website”, by ticking the relevant box, acceptance, in the form on the Website simultaneously with accepting the terms of the public offer, acting freely, of their own will and in their own interest, and confirming their legal capacity, hereby gives consent to the processing of personal data, hereinafter referred to as the “Consent”, to Individual Entrepreneur Tochenova Eleonora Yuryevna, INN 291800519008, OGRNIP 326350000021481, email address: tochenova2000@mail.ru, hereinafter referred to as the “Operator”, under the following terms.
1. This Consent is given for the processing of personal data both with and without the use of automated means.
2. Consent is provided by the Data Subject at the moment of placing an order, submitting an application, or sending an inquiry on the Website by ticking the relevant box in the form. The date and fact of granting Consent are recorded by the Operator. Consent is given simultaneously with the acceptance of the terms of the public offer published on the Website.
3. Consent is given for the processing of the following personal data, which does not belong to special categories of personal data or biometric personal data:
  • name of the Data Subject;
  • contact details of the Data Subject: phone number and/or messenger username or identifier, including Telegram or WhatsApp, and email address;
  • information about the order recipient: recipient’s surname and first name, delivery address, recipient’s phone number;
  • information about the order: order description, product links, desired date, and other information specified in the form;
  • information about completed payments;
  • other information voluntarily provided by the Data Subject when placing an order or contacting the Operator, including the content of the inquiry.
The Operator does not request or store the Data Subject’s bank card details. The entry and processing of such details are carried out by the bank and the engaged payment service provider.
4. If the recipient of the order is not the Data Subject but another person, the Data Subject confirms that they have obtained the consent of the recipient and other third parties to the transfer and processing of their personal data by the Operator to the extent necessary for fulfilling the order, and bears responsibility for having such consent.
5. The purposes of personal data processing are:
  • conclusion and performance of an agency agreement concluded under the terms of the public offer published on the Website;
  • arranging, paying for, and supporting orders with sellers, and organizing delivery of the order to the recipient;
  • reviewing and processing orders and inquiries received through the Website, maintaining communication with the Data Subject, including through messengers;
  • carrying out settlements, accepting payments, and refunding funds;
  • reviewing claims and resolving disputes;
  • maintaining accounting and reporting records, and fulfilling obligations imposed on the Operator by the legislation of the Russian Federation.
6. During the processing of personal data, the Operator performs the following actions: collection; recording; systematization; accumulation; storage; clarification, including updating and modification; extraction; use; transfer, including provision and access; blocking; deletion; destruction.
7. The Operator has the right to transfer or provide access to the personal data of the Data Subject and the order recipient to third parties to the extent necessary to achieve the purposes of processing, in the following cases:
  • to sellers and delivery services — for the purposes of placing the order and delivering the order to the recipient;
  • to banks and payment services, including the Robokassa payment service — for the purposes of carrying out settlements and accepting payments;
  • to providers ensuring hosting and operation of the Website, including Selectel LLC and Yandex Cloud — to the extent necessary for hosting and ensuring operation of the Website;
  • to persons providing technical support on behalf of the Operator, as well as accounting and reporting services for the Operator — to the extent necessary for providing the relevant services;
  • to state authorities and other persons — in cases provided for by the legislation of the Russian Federation.
When transferring personal data to persons processing such data on behalf of the Operator, the Operator ensures that such persons comply with the requirements of the legislation of the Russian Federation on personal data.
8. Personal data collected through the Website is stored on servers located in the Russian Federation, using the infrastructure of Selectel LLC and Yandex Cloud.
9. Personal data is processed for 30 days from the date of receipt if the Data Subject refuses to enter into an agreement, or for 5 years from the date of termination of the agreement if such agreement is concluded. Upon expiry of the processing period, personal data shall be destroyed, except in cases where storage for a longer period is provided for by the legislation of the Russian Federation.
10. Consent may be withdrawn by the Data Subject by sending the Operator a statement in the form of an electronic document to the following email address: tochenova2000@mail.ru.
11. If the Data Subject withdraws Consent, the Operator has the right to continue processing personal data without the Data Subject’s consent where there are grounds provided for in Clauses 2–11 of Part 1 of Article 6, Part 2 of Article 10, and Part 2 of Article 11 of Federal Law No. 152-FZ of 27 July 2006 “On Personal Data”.
12. This Consent remains valid until the processing of personal data is terminated in accordance with Clauses 9–11 of this Consent.
